Can You Sell Land With Back Taxes?

By Noah Swope, 77 Land Group · 5 min read

Falling behind on property taxes for land you don't use is more common than most people think. Life gets busy, the land isn't making you any money, and the tax bill gets pushed to next year. Then it grows.

The good news: you can usually still sell land that has back taxes.

How back taxes are handled when you sell

In most sales, the title company looks up exactly what's owed, including any penalties and interest. That amount is paid directly out of the sale proceeds at closing, before the rest of the money goes to you. You don't have to come up with the cash first.

For example, if you sell your land for $100,000 and $6,000 in back taxes is owed, the title company pays the $6,000 at closing and the balance goes to you (minus any other payoffs).

Why it helps to reach out sooner

Unpaid property taxes keep adding penalties and interest over time, so the sooner you sell, the more money stays in your pocket. The rules are different in every state and county, and your county tax office can tell you exactly where you stand. Either way, you've got options, and I'm happy to talk it through.

Can you sell if the land is already headed to a tax sale?

Often, yes, as long as we close before the sale date. If you're up against a deadline, call or text me and I'll move as fast as I can with the title company.

Back taxes don't scare me off one bit. The title company pays them off at closing, you walk away with the rest, and you're done with the tax bills.
